These Terms of Service ("Terms") are a legal agreement between you and CashSmart Inc. ("CashSmart," "we," "us," or "our"), the company behind the MoneyWise mobile application and related services (collectively, the "Service").
By creating an account, downloading the app, or otherwise accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
You must be at least 18 years old and capable of entering into a binding contract to use MoneyWise. By using the Service, you represent and warrant that you meet these requirements. The Service is intended for users located in the United States.
If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
To access most features of MoneyWise, you must create an account. You agree to:
We reserve the right to suspend or terminate accounts that contain false information or that we believe have been compromised.
MoneyWise uses Plaid Inc. to connect to your bank accounts and credit cards. By linking a financial account, you:
You may unlink any financial account at any time from within the app. Unlinking stops further data collection from that institution but does not delete previously collected transaction data unless you also delete your account.
You agree not to use the Service to:
We reserve the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated these restrictions.
The Service, including its design, text, graphics, logos, and software, is owned by CashSmart Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited license to use it as described herein.
You retain ownership of any data you upload to the Service (such as credit card statements). By uploading content, you grant CashSmart Inc. a limited, non-exclusive license to process that content solely for the purpose of providing the Service to you. We do not claim ownership of your financial data.
If you submit feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without compensation to you.
The card recommendations, cashback calculations, and inflation insights provided by MoneyWise are based on publicly available rewards data and your transaction history. They are provided for informational purposes only. Rewards programs, card terms, and earning rates change frequently and may not be accurately reflected in the Service at all times.
You are solely responsible for evaluating the suitability of any credit card or financial product for your situation.
MoneyWise may offer free and paid subscription tiers. If you subscribe to a paid plan:
Free tiers and trial periods are subject to eligibility requirements and may be modified or discontinued at any time.
You may delete your account and stop using the Service at any time from within the app or by contacting dingdong@moneywise.finance.
We may suspend or terminate your account at any time, with or without cause, including if we believe you have violated these Terms or if required by law. We will make reasonable efforts to notify you before termination except where doing so would be impractical or where immediate termination is necessary to prevent harm.
Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (including Sections 7, 8, 11, 12, 13, and 14) will continue to apply.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant the accuracy, completeness, or timeliness of any card rewards data, cashback calculations, or inflation estimates displayed in the Service.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CASHSMART INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL CASHSMART INC.'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the limitation of liability for certain damages, so the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless CashSmart Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles.
Any dispute arising from or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will take place on an individual basis. Class actions and class arbitrations are not permitted.
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm while arbitration is pending.
Before initiating arbitration, please contact us at dingdong@moneywise.finance so we can attempt to resolve the issue informally.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. If the changes are material, we will notify you via the app or by email at least 14 days before they take effect.
Your continued use of the Service after updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
